Alec Baldwin made headlines back in 2021 due to an unfortunate incident where he accidentally shot and killed a crew member while on set. He allegedly fired a prop gun that ended up lethally wounding the cinematographer Halyna Hutchins. That being said, it seems he will not be facing charges for shooting the director of his ‘Rust’ film.

As previously reported, Alec Baldwin was charged with involuntary manslaughter. Rust’s first assistant director, David Halls, agreed to plead guilty to negligent use of a deadly weapon.

According to TMZ, Alec Baldwin will not be charged with the shooting of “Rust Director” Joel Souza, despite the fact he was hit by the same bullet that killed Hutchins.

The Santa Fe District Attorney’s Office stated that regarding the Souza incident, there is no crime. According to the District Attorney, the shooting of Souza cannot be classified as an “unintentional battery” as it does not exist. A battery requires a specific intent to cause harm, which the D.A. states Baldwin did not possess. The case against Baldwin is based on the accusation of recklessness.

Actor Douglas Stewart, who had been working on the set of the film “Rust” prior to the fatal incident, recently appeared on “TMZ Live” and stated that throughout his decades-long career in the film industry, he has never seen an actor personally check the chamber of a gun. In fact, he claims that actors are prohibited from doing so and instead rely on the expertise of armorers to ensure the safety of all on set.

If the case proceeds to trial, it is likely that Baldwin’s legal team will argue that the actor was simply following established industry practices, and that this does not constitute recklessness.

Additionally, there have been criticisms that the District Attorney may be charging Baldwin due to his executive producer role in the film, however, Stewart has stated that Baldwin was not in charge of the production, and that his executive producer credit was primarily for the purpose of receiving back-end profits.
