Kanye West is currently facing a large-scale boycott. After making anti-Semitic statements, comments about race, and the death of George Floyd, many companies have severed ties with him. Kanye West was recently sued for copyright infringement over his Donda 2 song ‘Flowers.’

Donda 2 followed in the footsteps of the rapper, who is known for sampling many artists on his albums. This time, however, the rapper is being sued by Trax Records for failing to obtain permission to sample one of their songs. According to the lawsuit obtained by The Blast, Ye sampled Marshall Jefferson’s “Move Your Body” on “Flowers,” a song allegedly about his estranged ex-wife Kim Kardashian.

According to Trax Records, “Move Your Body” is instantly recognizable as “The House Music Anthem.” According to the filing, Ye did not obtain permission to sample the song on his album, and to make matters worse, the “unauthorized sample taken by West is repeated at least 22 times throughout Flowers.”

West’s unauthorized use of “Move Your Body” constitutes an unambiguous infringement of the copyright in the musical Master Recording “Move Your Body,” and of course is a blatant exploitation of the work without permission and compensation. Manifesting the height of hypocrisy, West advocates for artists’ rights with one hand, yet has no shame in taking away rights from another artist with the other.

Trax Records believes Kanye West has cheated them. Ye is being sued for profits and damages up to the maximum allowable amount of $150,000. Trax is also seeking a preliminary and permanent injunction to prevent Ye from infringing on any right in and to the Master Recording in any way, directly or indirectly.
