Ed Sheeran is a massive pop star. However, that’s not without receiving negative attention and legal trouble. The star recently won a copyright lawsuit for his song “Shape Of You.” However, he must go through another trial for his hit, “Thinking Out Loud.

Sheeran’s legal team recently filed a bid to dismiss a copyright infringement suit for the song. Sadly, U.S. District Judge Louis Stanton in Manhattan denied the bid, which means the case is moving on to trial.

The copyright infringement suit is one of three lawsuits against the star, all for the same hit. As per the suits, the song is based on Marvin Gaye’s 1973 classic “Let’s Get It On.”

Judge Stanton said while dismissing the bid that a jury has to determine whether the songs are identical. Music experts on both sides of the case present their arguments, which led to a stalemate.

Although the two musical compositions are not identical, a jury could find that the overlap between the songs’ combination of chord progression and harmonic rhythm is very close.

The lawsuit comes from Structured Asset Sales, who own a portion of the original song. An attorney from the company’s legal team, Hillel Parness, told the agency that they are happy with the ruling. Sheeran has won a legal battle before. Let’s see whether the jury deems him guilty or not.
