Kim Kardashian Can Finalize Divorce Without Kanye West’s Cooperation

Kanye West & Kim Kardashian were always in the news and certainly became one of the most popular celebrity couples. However, Kim Kardashian filed for divorce from West after seven years of marriage earlier this year. It seems Kardashian can finalize her divorce from West without him being involved.

Kim Kardashian made it clear a while ago that she has no intention of changing her last name and will still keep West as her last name for the sake of their children. Kanye West also recently claimed that he hasn’t seen the divorce papers, so he still considers Kim Kardashian as his wife. Kardashian then made it clear she will send him the papers.

For the past few weeks, Kanye West has been trying hard to get Kim Kardashian’s attention. In fact, he almost admitted he made mistakes and wants Kim Kardashian back. Kim Kardashian also made it clear she has no interest in his antics.

While speaking to Hollywood Life, Morghan Leia Richardson, Esq., the Matrimonial Partner with Davidoff Hutcher & Citron LLP in New York City explained how Kim Kardashian can push the divorce through “with or without” Kanye West’s cooperation.

“Bifricate means to separate the issues. Kim is asking the court to legally divorce her, but not decide the ancillary issues (custody, support, assets). [She] can request a hearing to be divorced legally, and a court can issue a decision without him. Aside from the new title (Esquire), she may also want to figure out new tax filings, or maybe she really just wants to be able to say he’s officially her ex-husband.

In California, Kim can finalize, or receive a ‘declaration of divorce’, with or without Kanye’s cooperation. So, if one spouse refuses to participate, the other can still get the divorce (and many times get what they are asking the court to award). This is why it is important to respond when one is served papers!

She’s asking the court to allow the divorce to take place and she sounds frustrated that he’s allowing it to linger on. She likely just wants to start a new chapter and this is holding her back.”

Kim Kardashian also recently stated that there is no way she can reconcile with Kanye West. With Kim Kardashian clearly having moved on from Kanye West, it remains to be seen how long Kanye West will continue to be upset. On top of that, he even purchased a bachelor pad in Belgium previously, so it seems unlikely the two will ever get back together.
